Not illustrated. 1793 Excerpt: ...if the appellant, after issue joined, either negleEls to take out any venire the fame term, &c. or takes one out, hut doth not get it returned, it seems that the defendant may take one out by proviso, &c. And so if the appellant make the like default in suing out an habeas corpora, or other subsequent process, the defendant may sue out the like process by proviso. 2 Hawk. PI. C. 407, 408. cap. 41. s. 10. 10. Where the defendant hath sued out any process by proviso, there are authorities that the plaintiff is to sue out the proper subsequent process upon it in the fame manner as if he had sued out the first. 2 Hawk. PI. C. 407, 408. cap. 4t. s. 10. 11. It seems agreed, that neither in aclions wherein the king is L 294 J file party, nor in inditlments, there can be any process taken out by proviso, because no laches is imputable to the king. Also it hath been questioned whether there can be any such process in informations qui tarn, because the king is in some sort a party. 2 Hawk. Pi.C. 407, 408. cap. 41. sect, 10. (C. e) Process upon Issues. Venire facias. What rA lhall be a good Award of the Venire facias. p'. N trespass againff 2, is the one pleads, and upon his plea 2 issues f_' S & are joined, and 2 other issues also joined, and the Court awards Two issues a venire ad triandum exitum ilium quam pradiclum aliutn exitum be-were joined, tween the plaintiff and the other defendant, &e.
